Transgender harassment and discrimination in the workplace


Every employee deserves to work in an environment that is free from harassment and discrimination. Unfortunately, this is not always the case. Harassment and discrimination - although illegal - are a reality in many U.S. workplaces.

Transgender employees often face difficulties in the workplace based on their gender identity.

According to the Human Rights Campaign, one in five transgender employees have reported experiencing some form of work-related discrimination. Some examples of unfair and illegal treatment they may experience include:

  • Misgendering (Intentionally referring to a transgender person by the wrong pronoun)
  • Name calling
  • Making inappropriate jokes or comments about an individual going through a gender transition
  • Failure to hire a job applicant because of transgender status
  • Failure to promote an employee because of transgender status
  • Treating a transgender employee differently or unfairly because of transgender status

Prison employee filing discrimination lawsuit

A transgender corrections officer at the California State Prison is filing a discrimination and hostile work environment uit against her employer, the State of California. She claims that her employer has failed to address complaints of misgendering by fellow employees. Work-related stress has caused her physical and mental distress.

Additionally, she feels as though she isn't respected by fellow employees, making her the target of inmates. She said that her employer failed to notify her of a death threat against her.

Victims have legal options

Discrimination or harassment against an employee on the basis of gender identity or sexual orientation is illegal. Victims are protected by the law and may be eligible for compensation.
