
Company reorganizations are a reality in the business world.
A reorganization (or reduction in force) often results in the termination of employees. This is never a fun thing for an employee to go through – but it’s a reality in the business world.
Unfortunately, some employers use company reorganizations as an excuse to discriminate or retaliate against certain employees.
The following may be examples of illegal discrimination or retaliation during a company reorganization or reduction in force:
- Targeting older employees, employees of a certain race or religion, LGBT employees, employees who recently took or will be taking pregnancy leave, and employees who are a part of another protected class
- Targeting employees who have recently filed a claim against the company (such as reporting the employer for discrimination or reporting illegal activities in the workplace)
These are illegal acts. Employee victims may have legal rights and may be eligible for compensation.
