Discrimination against an employee on the basis of age is illegal. Yet age discrimination still happens in workplaces across California.

Many older workers experience undesirable treatment from their employers, managers, and colleagues. Offensive remarks, lower pay, and other examples of unfair treatment do not have to be tolerated. But taking action can be frightening for workers. They may not know what to do or whether what they have experienced is actually age discrimination.

Examples of age discrimination

Are you the victim of ageism at work? Here are some examples of conduct that may be considered age discrimination:

  • Making inappropriate or offensive remarks regarding age
  • Failing to offer training or educational opportunities to older workers
  • Forcing an older worker to retire
  • Paying older workers less than younger worker for the same job
  • Assigning certain undesirable tasks to older workers
  • Describing the work environment as “young and energetic” (or something similar)
  • Refusing to interview an employee for a job, assuming the employee will soon retire

There are many other examples of age discrimination. If something has happened to you that seems questionable, it is advisable to speak to an employment law attorney. Workers over the age of 40 are protected by state and federal age discrimination laws and may be eligible for compensation.
