What are your major rights as an employee?

Employees often make the mistake of thinking that the boss is in charge of everything, as if they have no rights at all. While the typical corporate model does mean the boss is in charge, of course, that doesn't strip employees of basic rights or mean that the boss can take advantage of them just because of his or her position of power. For example, employees have these rights:

Whistleblower's rights to one's personnel file

It is unfortunate when employees realizes they are working in the midst of illegal activity or wrongdoing by their employer, or others at their job. It is even less fortunate when they chose to do the right thing and expose the wrong doing, but later suffer retaliation for that action.

California protects you from wrongful termination in a layoff

Like many employees, you might wonder exactly what would happen if your company were to experience significant losses that led to layoffs. For many Californians, that is not only a bad dream -- mass layoffs are very much a reality. The good news: You are protected with the Work Adjustment and Retraining Notification Act.

California surrogate claims discrimination, can't pump at work

A California woman who is a gestational surrogate is suing her employer for the right to take lactation breaks. The woman, who does not have an infant at home but still needs to pump breast milk to send to the baby's parents, says she has been the target of sex discrimination by staff members at the LAX Marriott. The woman says that she was denied the opportunity to pump breast milk at work even though her doctor sent a note indicating its benefits.

Attorney Michael Bononi Quoted in Britney Spears Case

Back in 2010, employment law attorney Michael Bononi was quoted at length in an article about a sexual harassment lawsuit filed by pop star Britney Spears's former bodyguard. The bodyguard, Fernando Flores, alleged that the singer made multiple unwelcome sexual advances on numerous occasions.

Protecting your whistleblower documents from workplace searches

Your home is your castle -- but your cubicle may not be. Many Californians do not realize that their personal work space can be subject to searches from their employers, and that includes your computer. Although whistleblower protection laws exist to protect those who have identified and stored information about an employer's unethical or illegal conduct, you might not have as many workplace privacy rights as you think.
