Father takes FLMA leave to raise baby of mother in coma

Many fathers take family leave in order to spend time bonding with their newborn daughters and sons. Others may separately take medical leave in order to take care of a sick relative. In a recent case, the two rationales for taking time off from work became merged.

A father is taking time off from his job in order to be the primary caregiver of his newborn baby daughter. The daughter, whom he named Angel Noemi, was born several weeks premature. She currently weighs 6 pounds, 2 ounces and needs a lot of care, which her father is capably providing. His parents are also helping out.

The mother of the baby, the man's wife, is in the hospital. She was hit by a tow truck driver when she was crossing the street. The accident left her with serious injuries that impair her ability to speak and her ability to access her own memories.

The driver who hit her did so while making a left turn during a yellow light. A charge of failure to yield to a pedestrian was filed against him. The woman was halfway across the street when he hit her. After the accident, doctors induced a coma with the intention of helping her body deal with the trauma.

Two weeks later the woman, who was 8 months pregnant, began having contractions. The couple's daughter was delivered by Cesarean section and has been in her father's care ever since. The mother is undergoing rehabilitation with an uncertain future. The father is not sure she even recognizes their daughter. He is glad that he's able to take time off from work to be the primary caregiver of their baby.

Other fathers might want to look into the leave they can take with the help of a California employment law attorney. This is especially true if employers do not follow the Family Medical Leave Act, which defines when someone is allowed to take time off to care for a new baby, other family member or his or her own health issues.
